Employees State Insurance Corporation Notification

The Employees' State Insurance Corporation (ESIC) vide a notification dated 12th January 2022 (Published in the Gazette of India on 27th January 2022) has decided to reduce the eligibility condition of 2 years to 12 months of insurable employment before unemployment as the eligibility conditions for the Atal Beemit Vyakti Kalyan Yojana (ABVKY). This provision shall be effective retrospectively from 1st July 2021.

The Atal Bimit Vyakti Kalyan Yojna (ABVKY) as a welfare measure for employees covered under ESI Act 1948 in the form of cash compensation to be paid to the insured person at 50% of wages for 3 months who lost their jobs for various reasons. Relief becomes due for payment after 30 days from date of unemployment and claim can be submitted directly to the designated ESIC Branch Office by the worker or made online at website www.esic.in along with submission of the physical claim with an affidavit, photocopy of Aadhaar Card and Bank Account details to the designated ESIC Branch Office by post or in person.

This extended relaxation to avail ABVKY relief shall be granted subject to the following terms and conditions –

1.The Insured Person should have been in insurable employment. Prior to this notification, this provision was that- insured Person should have been in insurable employment for a minimum period of two years immediately before his/her unemployment.
2.The employee must be in insurable employment for a minimum period of 12 months immediately before his/her unemployment.
3.The Employee should have contributed for not less than 78 days in the one completed contribution period in 12 months immediately preceding to unemployment.
